Terms of Service.

1. Who we are

FundedPlan, LLC ("FundedPlan", "we", "us", "our") is a Delaware limited liability company headquartered at Dover, DE 19904, United States. We provide business plan and financial model production services. By using our website or purchasing a package, you ("you", "customer") agree to these terms.

If you are entering this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.

2. The service

We produce two editable deliverables — a business plan (.docx) and a 5-year financial model (.xlsx) — based on the information you provide through our questionnaire and supporting documents.

We may also offer optional add-ons (rush delivery, additional revisions, custom branding) at the prices listed on the website at the time of purchase.

3. Eligibility

You must be at least 18 years old and able to enter a binding contract in your jurisdiction. The service is intended for business use. Our deliverables are not financial, legal, tax, or investment advice.

4. Your responsibilities

• Provide accurate, complete information through the questionnaire.
• Respond to clarification requests within a reasonable time.
• Use the deliverables for lawful purposes only.
• Not use the service to defraud lenders, investors, or any third party.
• Not reverse-engineer, scrape, or attempt to disrupt our systems.

5. Account security

If you create an account, you are responsible for keeping your login credentials confidential and for any activity under your account. Notify us immediately at support@fundedplan.com if you suspect unauthorized access.

6. Payment

Packages are flat-fee, one-time purchases unless explicitly described as subscriptions. Payment is due at the time of order and processed by our payment processor (Stripe). Prices are listed on the Pricing section and are exclusive of any taxes that may apply in your jurisdiction.

Failed payments, chargebacks, or disputed transactions may result in suspension of work or access until resolved.

7. Turnaround

Standard turnaround is twelve (12) hours from the time the questionnaire is submitted in full and payment has cleared. Turnaround clocks pause while we wait for clarifications from you. Rush delivery is available at additional cost.

8. Revisions

Each package includes the number of revision rounds described on the Pricing page. Additional revisions are available at the rate posted at the time of request. Revisions are limited to the scope of the original brief; substantial pivots may be quoted separately.

9. Intellectual property

Once payment is complete, you own the deliverables outright. You may use, edit, distribute, and present them however you wish. We retain no rights over your project content.

Our website, brand, templates, prompts, and underlying production system remain our intellectual property. Nothing in these terms transfers ownership of those to you.

With your consent, we may use anonymized excerpts of your project as a sample or case study. We will never publish your project without your prior written approval.

10. Refunds

Because work begins immediately and the deliverables are custom, refunds are not available after work has started. If you cancel before our team begins, you receive a full refund. If you are unhappy with delivery, contact us at support@fundedplan.com and we will work with you to make it right.

11. Acceptable use

You agree not to use the service to create deliverables that contain false or misleading financial information, infringe third-party intellectual property, promote illegal activity, or otherwise violate applicable law. We may refuse or terminate work that we reasonably believe violates this section.

12. AI usage

We use AI tools internally to produce your deliverables. Your business information is never used to train any AI model, and our third-party AI providers are configured for zero data retention. See our Privacy Policy for detail.

13. Disclaimers

The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Our deliverables are professional work products. We do not guarantee that any specific lender, investor, or government agency will approve your funding application. We are not liable for outcomes that depend on third-party decisions.

14. Limitation of liability

To the maximum extent permitted by law, FundedPlan and its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or in connection with your use of the service.

Our total aggregate liability for any claim arising out of these terms or the service is limited to the amount you paid us for the package giving rise to the claim in the twelve months preceding the claim.

15. Indemnification

You agree to indemnify and hold FundedPlan harmless from any claim, loss, or expense (including reasonable legal fees) arising out of (a) your use of the deliverables, (b) information you provided that was inaccurate or unlawful, or (c) your violation of these terms or applicable law.

16. Termination

We may suspend or terminate your access to the service if you breach these terms, attempt fraudulent activity, or cause harm to other users or our systems. You may stop using the service at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

17. Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute arising out of these terms or the service will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

Nothing in this section limits any non-waivable rights you may have under the law of your home jurisdiction.

18. Changes to these terms

We may update these terms occasionally. The current version is always posted on this page with the "Last updated" date. Material changes will be communicated by email or in-app notice before they take effect. Continued use of the service after a change constitutes acceptance of the new terms.

19. Severability and waiver

If any part of these terms is held unenforceable, the rest will remain in full effect. Our failure to enforce any part of these terms is not a waiver of our right to enforce it later.

20. Entire agreement

These terms, together with our Privacy Policy and Cookies Policy, are the entire agreement between you and FundedPlan regarding the service and supersede any prior agreement on the same subject.
